Fly tipping on private land is the owner's legal problem, not the council's. Birmingham City Council will remove waste dumped on the public highway and on council-owned land, but if the material lands on your driveway, car park, service yard, farm gateway, alleyway or the garden of a property you let out, responsibility for clearing it and paying for lawful disposal falls to you as the landowner or occupier. That paperwork is not a formality. Under the Environmental Protection Act 1990 you carry a duty of care for waste that originates from your property, including waste you did not put there. Should you report fly tipping to the council instead? Reporting is also worth doing even for a private-land tip, because the council's enforcement team investigates evidence found in the waste and can issue fixed penalty notices of up to £1,000, or prosecute. What reporting will not do is get privately dumped waste removed. Our advice is simple: photograph it, report it for enforcement, and book a private clearance to get the site usable again.

Prevention is cheaper than repeat clearance. After a clearance we are happy to advise on the practical measures that actually work on Birmingham sites — a lockable height barrier or dropped bollard on a car park entrance, motion-triggered lighting on an alley, a camera covering the access point, keeping hedges and verges cut back so the spot is visible from the road, and never leaving your own bulky items out overnight.
